1. The conclusion of the contract about the participation.
The applicant (the physical person, the legal person, collective of the participants without formation of the legal person, the sponsor, the investor, etc.) _________________________

Wishing to take part in the festival, simultaneously with the Application, Russia, Saint Petersburg concludes with the Organizer of the Festival of Open Company " Pearl ", Petersburg, with the instruction of the purposes of use of listed means.
The contract consists the Applicant or its financial representative
(The sponsor, the investor, etc.) with the instruction of requisites of the payer also extends on everything specified in the Application of participants of action, taking up the same treaty obligations which were accepted by personally Applicant.
The contract inures from the moment of signing by its parties.
The organizer renders transport services on written to the request of the Applicant.
2. Target use of the means.
Target use of means of the Applicant is provided with the coordination of the conditions of stay of participants on action at the conclusion of the Contract.
Special conditions of accommodation-granting of single rooms or prolongation of stay in the country, additional excursions and an additional feed, can be considered as a wish only in the event that they are in addition specified in the Application, or confirmed properly by the parties in the additional agreement.
The advance payment, registration payment, other transfers go on the Settlement account of Open Company " Pearl ", further under the text the Organizer, according to the Contract.
In case of payment of advance payment and a payment for participation in action by cash means from the Applicant, the Organizer stands out written acknowledgement of such form of payment.
The advance payment and other forms of payment acting on the With transfer, the Applicant bears. The advance payment is transient.
3. Unilateral refusal of the Contract.
Payment, advance payment, advance payment, official registration of papers, departure action, others actions are considered as the consent of the Applicant with the treaty provision.
Refusal of the Applicant of the Contract before departure action moves to the Organizer in written form with the instruction of the reasons of refusal.
The applicant is obliged to pay to the Organizer actually suffered expenses at the moment of refusal.
Base at refusal following calculations of the penalty under obligations are accepted:
60-31 day prior to departure-10 from a total sum;
30-15 days prior to departure-30 a total sum;
15-4 days prior to departure - 50 from a total sum;
Less than 4 days before departure-100 from a total sum;
4. Refusal of the Organizer of the Contract.
Prior to the beginning of action or in current of action the Organizer can refuse the Contract on the organization of participation and terminate the Contract in following cases:
At non-observance by the Applicant of terms of payments, submissions of data for registration of the visa and other documents;
If 2 weeks prior to departure festival the group cannot type the minimal number of participants specified in the program;
In other cases if the Applicant does not carry out the treaty provision;
The Organizer immediately informs on refusal of the Contract to the Applicant. The organizer has the right to demand from the Applicant of compensation of actually suffered charges under the Contract.
5. Action force majeure circumstance, force-majeur.
Difficulties, danger or negative influence during participation in the action, caused unforeseen or force majeure in the form of wars, strikes, internal disorders, epidemics, the state orders, natural cataclysms, destructions of places of a lodging for the night, technical defects of vehicles or similar on the importance events, entitle both parties which have signed the Contract, to its cancellation. The organizer can demand compensation of damage for already performed work or still forthcoming expenses on the organization of participation.
6. Obligations of the Organizer.
The organizer answers within the limits of obligations of careful execution of a commercial duty for:
1) the diligent organization;
2) careful selection of partners and preparation of participation in action;
3) completeness and reliability of the given information;
4) execution of obligations under the Contract;
At execution obligations the organizez is guided by Contracts and the agreements signed by the interested parties.
The organizer does not bear the responsibility under obligations of the third parties by preparation and carrying out of action.
The organizer is not responsible for safety of personal things, documents, values and money resources of participants during the moment of pass of borders, in places of residing, carrying out of competitions and concerts, in places of carrying out of leisure.
7. Regulations about the passport, customs, visas.
The organizer does not make preliminary expert examination of the passport on presence of any stamps or marks, the signature of the owner, completion dates of the passport, does not check reliability of given documents and biographical particulars. For performance of the listed positions the participant of festival answers.
If the participant charges to the Organizer registration of visa documents it should to give strictly in the stipulated terms to the Organizer all necessary documents for registration of visas. The list of documents for each Embassy and terms of submission contain in the covering letter, directed to the participant
The organizer after reception of its application.
The organizer bears the responsibility for granting of a trustworthy information about necessary documents for reception of visas and for timeliness of granting in Embassy of documents of the participant. The organizer does not bear the responsibility for actions of the Embassy and refusal of Embassy in issue of visa to the participant. Consular gathering thus does not come back. In this case to the participant comes backpation after departure FestivalSettlement account of the Organizer in the Russian roubles are set off at the rate of the Central Bank of the Russian Federation in day of brought a payment minus expenses actually suffered by the Organizer.
The organizer does not bear the responsibility for duration pass of borders and not execution by the Participant of customs rules.
8. Action of conditions of participation in action.
The given Position is uniform for all Contracts on participation in action. The applicant who has listed means for the Settlement account of the Organizer, agrees with the given conditions.
All offers on change of the given conditions are accepted only in a written kind and have a validity after written signing by both parties. |
